Rewards Program will start early - October 1, 2006 to help us kick
off our new locations in Atlanta & Tampa. Please email us
with your suggestions for the grand prize. Location will be
finalized by December 31, 2006 based on your responses.
Current leading candidates are a return trip to Las Vegas, Cancun
and a Cruise.
Current contest

The
Prize
The Prize is
defined as a trip for 2 individuals (the winner must be 21 or over)
to The Bellagio Resort Hotel & Casino in Las Vegas Nevada.
Pools, Ponds & Courts, Inc. will provide roundtrip airfare and
accomodations (1 deluxe room with 2 queen or 1 king size bed/ double
occupancy) at The Bellagio for 4 nights in the calendar year 2007
for those individuals winning the contest either by drawing or
automatic qualification in calendar year 2006. If you are an
automatic qualifier based on 5 placed referrals you may be eligible
to take your trip prior to January 1, 2007. Blackout dates do
apply to travel and lodgings. We will make every attempt to
satisfy requests within reason, but retain the right to blackout
certain dates surrounding holidays, etc.
The prize does not include rental car or ground transportation,
meals, taxes or any expenses above and beyond the airfare and
room. This also excludes room service and hotel sundries,
etc.
Referrals
Defined
A
referral is defined as referring an individual or business to Pools,
Ponds & Courts, Inc. for a minimum size project that we
ultimately build. That project (as defined below) must be
contracted, completed and paid-in-full during the calendar year
2006. Exceptions may be made at the sole discretion of Pools,
Ponds & Courts, Inc. and their directors, if completion is
unable to be made due to weather or materials difficulties. A
project may qualify for more than one referral as a total project
may have multiple different qualifying projects within the scheme of
a larger scale project.
Qualifying referrals are as
follows:
1. Any newly
constructed in-ground swimming pool and it's adjoining
concrete deck is considered to be a qualifying
project.
2. A putting
green in excess of 400 square feet of turf is
considered to be a qualifying project. If the putting green
project exceeds 2500 square feet of turf it shall count as 2
qualifying projects.
3. A
watergarden in excess of 150 square feet
of surface water with a waterfall flowing a minimum of 3000 gallons
per hour (at the pump) and falling at least 30". A watergarden
in excess of 900 square feet of surface water with waterfall(s)
flowing at least 7500 gallons per hour (at the pump) shall count as
2 qualifying projects.
4. A pondless
waterfall in excess of 3' in height (at the waterfall
unit exit) and flowing 3000 gallons per hour (at the pump) or more
shall qualify as 1 project. A pondless waterfall with water
falling in excess of 66" from the basin and flowing at 10,000
gallons per hour or more (at the pump) shall count as 2 referred
projects.
5. Any newly
constructed tennis court shall be considered a
qualifying project.
6.
Any newly constructed hardscape
(paver patio, retaining wall or flagstone project) exceeding 500
square feet of finished surface shall count as 1 qualifying project
and every 1500 square feet of finished surface beyond the initial
500 shall count as an additional qualifying project up to a maximum
of 4 qualifying projects in this category from any one
location.
7. Service work, when
agreed to by all parties to be a qualifying project, in writing,
before work is contracted. Generally speaking
service work is excluded.
Terms &
Conditions
1. Client
Eligibility - Client (that individual referring the
project) must be 21 years of age or older and must be an
individual (businesses do not qualify). Client must be a
full-time resident of the United States at the time of winning
and must be legally capable of taking the trip (must meet
qualifications of the airline and hotel). Client DOES
NOT HAVE TO BE A CUSTOMER OF POOLS, PONDS & COURTS, INC. to
participate. Referring yourself or another
member of the same household is specifically excluded.
2. Limitations of
Eligibility - This constest is not open to the directors, officers,
employees or business partners of Pools, Ponds & Courts,
Inc. (hereafter PP&C) Any referral is credited to the
first person referring the new customer, and any new customers
projects can only be counted for the first person referring
them. If a conflict arises regarding who referred a project
the new customer will be consulted and the final decision regarding
who will be credited for the referral will be made by Pools, Ponds
& Courts, Inc.
3. General Terms &
Conditions
(A) All taxes are the
responsibility of the winner. PP&C may file a Form 1099 with the
IRS and the award recepient.
(B) There are no cash
substitutes for the award unless unforeseen economic or
social or political conditions dictate that it is not feasible
or safe for the prize to be awarded in which case PP&C retains
the right to pay a cash award based on the prizes value at the time
the contest commenced (February 2006) Any cash award would be
no less than the value of the Prize at that time plus 30%
(approximately $2320 including 30% premium as of February 4,
2006). Feasability is at the discretion of
PP&C.
(C) Contest is void where
prohibited by law. Service and product award for this Contest
cannot be combined with any other promotion, product discounts or
incentive programs of any kind.
(D) Pools, Ponds &
Courts, Inc. reserves the rights to change or modify the contest at
any time. Any changes will be immediately available on this
website.
(E) The winner(s)
will be required to certify and complete an affidavit of eligibility
and liability and a publicity release to PP&C.
(F) The Winner(s) agree to
the use of their name, likeness, and/or photograph for advertising
and publicity purposes without compensation unless prohibeted by
law.
(G) By participating in the
Contest, all Participants, employees, the Winner(s), any guests,
users or transferees do hereby and now and forever release PP&C,
its affiliates, subsidiaries, directors, officers, vendors, benefit
plans, employees, agents and associates (including but not limited
to, advertising and promotional agencies, award suppliers, and
sponsors and their officers, directors, employees, agents,
successors and assigns) from and against all claims, demands,
actions, causes of action, losses, expenses, damages and liabilities
arising out of or in any way relating to the participation or
acceptance, possession or use of the prize.
(H) The Trademarks
displayed on the Program are registered and unregistered Trademarks
of Pools, Ponds & Courts, Inc. Nothing contained in the
Contest should be construed as granting, by implication, estoppel,
or otherwise, any license or right to use any Trademark displayed in
the Contest, or any license or right to use any other trademark
owned by any third party. In the event that anyone misuses any
Trademark in violation of these Terms & Conditions, PP&C
will aggressively enforce it's intellectual property rights to the
fullest extent of the law.
(I) Information in
the Contest is subject toi change without notice. Information
regarding PP&C's products and services is applicable only in the
service territory of PP&C in the United States as of the
time of the Contest, unless otherwise noted.
(J) Unauthorized use
of the information, materials or the Contest itself is strictly
prohibited and is a violation of the rights of PP&C and/or third
parties, including without limitation, under copyright laws,
trademark laws, and the laws of privacy and publicity.
(K) PP&C makes no
warranties or representations as to the accuracy, correctness,
reliability or otherwise with respect to information made available
concerning the Contest, and assumes no liability or responsibility
for any ommissions or errors (including without limitation
typographical errors and technical errors) in the context of the
Contest.
(L) PP&C maintains and
operates this Contest from its offices in the State of Ohio, in the
United States. These Terms & Conditions are governed and
interpreted under the laws of the State of Ohio, United States of
America. If any portion of these terms is deemed unlawful,
void or unenforceable, then that part shall be deemed severable and
will not affect the validity and enforceability of any remaining
provisions.
(M) These Rules,
Terms and Conditions set forth the entire understanding and
agreement between the Participant, PP&C and other parties with
respect to the Contest.
(N) All entries must
be made by 9/30/2006. A Winner will be drawn on or around
January 1, 2007. If a Participant becomes a Winner by virtue
of the automatic qualification, then the 5 referrals used for the
automatic berth shall be removed from the drawing. Additional
entries may be made after that time for the same individual for new
and additional referrals. The outcome of the random drawing
shall be final.
Limitation of
Liability
Participant understands and
agrees that PP&C is providing this invitation to an offer to
participate in this Contest for value with no consideration in
return from the Participant. This Contest does not constitute
any contractual relationship between the parties either express or
implied. Participant, any empoloyee of Participant, the
Winner(s), any employee of the Winner(s), and/or any third party
agrees to indemnify and hold PP&C, its directors, officers,
employees, agents, benefit plans, sponsors and suppliers harmless
from any and all liability of any kind resulting from this Contest
or any action related herewith.
